Agility said in a statement that the prosecutors’ motives for seeking a dismissal of the case at this time were “unknownâ€Â. However, it added that this request came after motions filed by Agility DGS Holdings to discover the government’s evidence against it, including Price Negotiation Memoranda, a set of exculpatory materials which it said that the US government had, “worked tirelessly to conceal from the public for over three yearsâ€Â. Agility commented that it strongly believed that the case should never have been brought in a criminal court in the first place. This case was at most, it said, a civil contract dispute over the interpretation of a contract drafted by the government.
US dismisses indictment against Agility
The US Attorney’s office in Atlanta has moved to dismiss an indictment against Agility DGS Holdings, the specialist defence logistics subsidiary of PWC/ Agility. Grand Jury charges levelled at Agility alleged that the company had conspired to defraud the US in its role as a prime contractor with respect to a Prime Vendor Contract involving the provision of Food and Non-Food distribution to US forces in Iraq, Kuwait and Jordan.
